Mediation
Mediation fees depend on the number of parties and amount in controversy. Generally, however, fees for full-day mediations are $1200 per party for two parties, and $1000 per party for three or more parties. Fees for half-day mediations are $600 per party. In this context, "party" means all persons or interests represented by the same attorney. Other Services
Fees for other services are usually based on hourly rates negotiated in advance, plus actual expenses. Other fee arrangements are possible and negotiable. For example, fees for mediation advocacy could be based on daily rates, plus a flat fee or hourly rate for preparation time. Similarly, fees for litigation management can be based on hourly rates or a monthly or annual retainer. The fee arrangement should always be discussed openly and negotiated in advance and, especially for first-time clients, will generally be reflected in a written agreement called an "engagement letter." Some of the factors to be considered in establishing a fee arrangement include the following:
(1) the time and labor required, the novelty and difficulty of the questions involved, and the skill required to perform the legal service properly;
(2) the likelihood that the acceptance of the particular employment will preclude other employment by the lawyer;
(3) the fee customarily charged in the locality for similar legal services;
(4) the amount involved and the results obtained;
(5) the time limitations imposed by the client or by the circumstances;
(6) the nature and length of the professional relationship with the client;
(7) the experience, reputation, and ability of the lawyer or lawyers performing the services; and
(8) whether the fee is fixed or contingent.
